Terms of Service

RealtorDesk is a cloud-based CRM for real estate professionals that provides contact and lead management, pipelines, calendars and booking links, listings and MLS data, documents, reporting, AI assistance, and email, SMS, and voice communications.

You must be at least 18 and able to form a binding contract. You are responsible for accurate account information, keeping your credentials secure, and all activity under your account. Organization administrators control access for their users.

You agree not to:

• Send spam, unsolicited messages, or messages to people who have not consented or who have opted out.
• Violate the TCPA, CAN-SPAM, CTIA guidelines, carrier rules, fair housing laws, MLS rules, or any other applicable law.
• Upload unlawful, deceptive, or infringing content, or content prohibited by carriers (such as SHAFT content: sex, hate, alcohol, firearms, tobacco).
• Attempt to access another organization's data, disrupt the Service, or reverse engineer it.

Program description: Real estate agents and brokerages using RealtorDesk send text messages to their clients and prospects, including appointment confirmations and reminders, responses to property and home-valuation inquiries, transaction and escrow updates, and real estate follow-up messages.

How you opt in: You consent to receive texts by checking the SMS consent box on a website, lead, or booking form, by texting the business first, or by giving express consent to your agent. Consent is not a condition of purchase.

• Message frequency varies based on your interaction with the agent.
• Message and data rates may apply.
• To opt out, reply STOP at any time. You will receive one confirmation message and no further texts. Reply START to resubscribe.
• For help, reply HELP or email hello@realtordesk.net.
• Carriers are not liable for delayed or undelivered messages.
• No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy.

Customer responsibilities: Customers who send messages through the Service are the message senders and are solely responsible for obtaining and documenting valid consent, honoring opt-outs, sending only the message types registered for their campaign, and identifying their business in messages. We may suspend messaging that violates these Terms or carrier requirements.

Customers are responsible for complying with call recording, consent, and telemarketing laws (including Do Not Call rules) when using voice calling or AI voice and text assistants. AI-generated content may be inaccurate and should be reviewed before relying on it.

You may sign in with Google and optionally connect your Google Calendar so RealtorDesk can check your availability and add booked appointments to the calendar you choose. By connecting, you authorize us to access your Google data only as described in our Privacy Policy. Our use of Google data complies with the Google API Services User Data Policy, including the Limited Use requirements. You can disconnect at any time from the Calendar page or at your Google account permissions. Your use of Google services is also subject to Google's own terms.

You own the data you put into the Service. You grant us a limited license to host, process, and transmit it only to provide the Service. You can export your data, and we delete it after account termination as described in the Privacy Policy.

Listing data is provided by MLS and IDX sources, is deemed reliable but not guaranteed, and is subject to those providers' rules. Third-party services (such as Twilio, Resend, and Google) are governed by their own terms.

Paid plans are billed as described at signup, on a recurring month-to-month basis unless stated otherwise, and may be cancelled at any time effective at the end of the current billing period. Fees are non-refundable except where required by law.

You may stop using the Service at any time. We may suspend or terminate access for violation of these Terms, non-payment, or to protect the Service, other users, or message recipients.

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, UpSurge CRM Pros is not liable for indirect, incidental, special, or consequential damages, and our total liability is limited to the amount you paid us in the 12 months before the claim.

You agree to indemnify us against claims arising from your content, your messages and calls, or your violation of these Terms or applicable law.

These Terms are governed by the laws of the United States and the state in which UpSurge CRM Pros is organized, without regard to conflict-of-law rules. We may update these Terms and will post the new effective date here; continued use means you accept the changes.
